These Website Standard Terms and Conditions written on this webpage shall manage your use of our website ‘What is your SQ’ accessible at www.whatisyoursq.com.

These Terms will be applied fully and affect to your use of this Website. By using this Website, you agreed to accept all terms and conditions written in here. You must not use this Website if you disagree with any of these Website Standard Terms and Conditions.

Minors (under 18s)

Persons below 18 years old are not allowed to use this Website nor make ISQ video submissions without consent from an adult (over 18 years of age).
Payments will be accepted only from persons of 18 years of age or older for annual subscriptions, video submission and coaching services (purchases can be made for minors by an adult, and the minor can be set up as a stand-alone member of the SQ community. The approved payment from an adult’s credit card will be considered by SQ as permission from an adult for the minor to join or submit videos).
Even with adult permission, no players under 8 years of age can be offered membership for whatisyoursq.com
For minors who have consent of the aforementioned parent of guardian (ie adult over 18 years of age) One Chance Snooker Limited will post their SQ related material as for all for members per the SQ data privacy provisions unless requested otherwise by the member in writing through our contact us page.

Intellectual Property Rights

Other than the content you own, under these Terms, One Chance Snooker Limited and/or its licensors own all the intellectual property rights and materials contained in this Website.

You are granted limited license only for purposes of viewing the material contained on this Website, downloading instructional videos or copying materials on this website is not permissible under this limited licence.

Restrictions

You are specifically restricted from all of the following:

publishing any Website material in any other media;
selling, sublicensing and/or otherwise commercializing any Website material;
publicly performing and/or showing any Website material;
using this Website in any way that is or may be damaging to this Website;
using this Website in any way that impacts user access to this Website;
using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity;
engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website;
using this Website to engage in any advertising or marketing.

Certain areas of this Website are restricted from being access by you and One Chance Snooker Limited may further restrict access by you to any areas of this Website, at any time, in absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.

In these Website Standard Terms and Conditions, "Your Content" shall mean any audio, video text, images or other material you choose to display on this Website (this includes both material shared openly on the site and material sent to the site to be viewed by our administration personnel). By displaying Your Content, you grant One Chance Snooker Limited a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be invading any third-party’s rights. One Chance Snooker Limited reserves the right to remove any of Your Content from this Website at any time without notice.

In no event shall One Chance Snooker Limited, nor any of its officers, directors and employees, shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. One Chance Snooker Limited, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

Indemnification

You hereby indemnify to the fullest extent One Chance Snooker Limited from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

One Chance Snooker Limited is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

Assignment

The One Chance Snooker Limited is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement

These Terms constitute the entire agreement between One Chance Snooker Limited and you in relation to your use of this Website, and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the State of the United Kingdom (UK), and you submit to the non-exclusive jurisdiction of the state and federal courts located in the UK for the resolution of any dispute

Additional Operating Conditions

Video Submissions

ISQ scores recorded with video submissions will not count towards your SQ (Snooker Quotient) score if they are assessed as taking a perceived advantage by changing any of the standard snooker and ISQ routine rules before and/or during play; including but not limited to; incorrectly setting up the balls, using non-standard equipment (balls, cues, table, pocket dimensions*) or mis-calculating routine scores.

If any breaches of this nature are found through video review, your ISQ submission will fail verification and your ISQ score will not count and you will need to re-submit the ISQ in question. No refund of points or monies will be made where the fault is your own;

You will be informed if your ISQ submission is under review for any concern related to validity, accuracy or credibility. If we do not hear from you within 14 days, our decision will be final and your ISQ video and its score will be struck from your account record. No refund will be available in this instance.
If we see an error that in any way influences the outcome of your ISQ score and that is beyond question in the video review we reserve the right to amend your score (up or down) to correct the error. You will not be informed in this instance. The SQ score amendment will be final.
If we see this has been a deliberate attempt to gain an advantage through cheating, i.e. deliberately and/or wilfully breaking rules to gain unfair advantage, a warning will be issued by email. A second confirmed case of attempted ‘cheating’ means your SQ membership will be cancelled with no refund of annual fees or any unclaimed SQ points

*NOTE – If SQ qualified coaches feel that non-standard pocket dimensions are being used, we reserve the right to apply a penalty percentage to the SQ scores submitted from this table, pending any follow up and review to verify the size of the pockets. This is similar to a standard scratch calculation in golf and is to ensure fair play and equity to the best of our ability. SQ senior coach decisions will be final in this matter.

For a listed SQ score to remain ‘active’ a member must complete at least four (4) different and separate ISQ submissions (to include Break Building, Cue Ball Control, Long Potting and General Skill ISQ submissions) within a 24 month period.

An SQ score that has not been updated by the completion and submission of at least one of each of the four (4) different ISQ tests in the previous 24 month period, will be deemed ‘inactive’ and set to 0.00. Another four (4) ISQs would then need to be submitted before a new SQ score can be considered ‘active’ on the same member’s account (as is the case for a new member).

Membership Renewal

After a grace period of ten (10) days post membership renewal date, a member’s account will be suspended if they have not paid the annual subscription due. A new account will need to be created and four (4) new ISQ submissions would need to be submitted before a new SQ score could be achieved (as in the case for a new member).

Points

Points purchased should be used in a timely manner related to your annual subscription. Any points remaining on expiry of membership, cannot be refunded. Members can only hold a maximum of 150 points in balance in their account at any one time.

Coaching Reports

Coaching reports as advertised may be removed or suspended at short notice if resource capacity is exceeded. Those who have already confirmed purchased coaching services will of course be provided with the selected coaching service – even after any suspension is applied

Special Offers

Please note that the terms "Register", "Join" or "Sign Up" in any special offer terminology, refers to the fact that a member must be 'fully paid up with an annual subscription (US$25.00) and have a subscription start date within the special offer period' to receive any offer listed.
